Terms and conditions of sale

1. Scope of Application

These General Terms and Conditions of Sale (GTC) apply to all sales of products and services concluded between Prestige Enterprise Sàrl, Route de Saint-Cergue 24, 1260 Nyon, Switzerland (hereinafter “the Seller”), and its professional clients (hereinafter “the Client”), in Switzerland and internationally.

Any order implies unconditional acceptance of these GTC.


2. Products and Services

Prestige Enterprise Sàrl designs, customizes, imports, and distributes promotional items, corporate gifts, textiles (pashminas, cashmere), medical & spa products, and leather goods. Some products are tailor-made in our partner workshops in India and Europe.

Images, descriptions, and technical specifications appearing in our materials are provided for information purposes only and are not contractual.


3. Orders

Orders must be confirmed in writing (email or signed purchase order). Once validated by the Client, all orders are firm and final.

Prestige Enterprise Sàrl reserves the right to refuse or cancel an order in case of prior dispute, non-payment, or non-compliant request.


4. Prices and Payment Terms

Prices are expressed in Swiss francs (CHF), excluding taxes unless otherwise specified. Delivery charges, customs duties, and other additional costs are borne by the Client.

Unless otherwise agreed, payment terms are as follows:

  • 50% upon order (deposit)
  • 50% upon delivery or prior to shipment

Invoices are payable within 30 days net. In the event of late payment, interest of 5% per year may be applied without notice, along with reminder fees.


5. Delivery Times

Delivery times are indicative and may vary depending on the type of product, customization, country of destination, or time of year.

Delays in delivery shall not entitle the Client to cancel the order or claim compensation, except in cases of gross negligence by the Seller.


6. Transport and Customs

Goods are shipped at the Client’s risk, unless Delivery Duty Paid (DDP) has been agreed in advance.

The Client is responsible for customs formalities and the payment of all import taxes (VAT, customs duties) in their country.


7. Claims and Returns

Any claim (defect, non-conformity, quantity discrepancy) must be made in writing within 5 working days of receipt.

No return will be accepted without prior approval from Prestige Enterprise Sàrl. Customized products are neither returnable nor exchangeable, except in the case of a clear error attributable to the Seller.


8. Intellectual Property

All designs, logos, mock-ups, prototypes, and graphic elements created by Prestige Enterprise Sàrl remain its exclusive property, unless otherwise agreed in writing.

The Client guarantees that they hold the necessary rights to have their logo, trademark, or visual applied to the ordered products.


9. Limitation of Liability

The Seller’s liability is strictly limited to the value of the order. The Seller shall not be held liable for indirect damages or commercial losses suffered by the Client.


10. Force Majeure

The Seller shall not be held liable in cases of force majeure (strike, war, natural disaster, pandemic, logistical blockage, etc.) preventing the fulfilment of its obligations.


11. Governing Law and Jurisdiction

These GTC are governed by Swiss law. Any dispute shall fall under the jurisdiction of the competent courts of the Canton of Vaud, the registered office of Prestige Enterprise Sàrl.
